TERMS AND CONDITIONS

These Event Terms (Terms) govern your attendance at public events held by Saltwater Eco Tours. It is your responsibility to review these Terms prior to boarding our vessel. By boarding, you agree to be bound by these Terms. We reserve the right to amend these Terms at any time and will provide the most recent version with your quotation. Throughout these Terms, the terms "Saltwater Eco Tours", "we", "us" and "our" refer to Saltwater Eco Tours and its associated entities, and "you" refers to the individual or business attending the event. Saltwater Eco Tours reserves the right to alter prices, schedules, or other published details without notice. 

ACCESSIBILITY 

32 passenger capacity. The vessel is not wheelchair accessible, however, crew can assist where possible for passengers to be seated comfortably on deck. Toilet is below deck (4 steps down ladder). 

REFUNDS AND CREDITS

Cancellations made less than 48 hours prior to the scheduled departure time will incur a 100% cancellation fee. No refund or credit will be issued. Failure to attend (no-show) will also incur a 100% cancellation fee.

Cancellations made between 7 days and 48 hours prior to departure may be eligible for a credit or voucher at our discretion. No refunds will be provided for cancellations within this period.

Credits or vouchers issued are valid for 3 years from the date of issue.

Cancellations within 7 days prior can receive a credit/voucher. No refunds within 7 days.

PRIVATE CHARTERS 

Private charters are required to pay a 20% non-refundable deposit upon booking. If you decide to cancel your private charter within 2 weeks of your booked charter date, we have the right to withhold 100% of your deposit. If you choose to reschedule your private charter, we will withhold the original deposit and a new deposit will be required for your new requested date. 

EVENT CANCELLATION

Minimum Passenger Numbers
A minimum of 8 passengers is required for a cruise to proceed. If this minimum is not met, we reserve the right to cancel or reschedule the cruise. In such cases, you will be notified via email or SMS. You will be offered the option to reschedule to an alternative date or receive a full refund.

Weather Conditions
The safety of our passengers and crew is our highest priority. If adverse weather conditions (including heavy rain or strong winds) are forecast, we reserve the right to postpone or cancel the cruise. We will notify you as soon as possible, and where practicable, within 24 hours prior to departure.

If your cruise is postponed or cancelled due to weather, you will be offered:

• the option to reschedule to a future date; or
• a credit/voucher to the same value, valid for 3 years.

If neither option is suitable, a refund may be provided at the owner’s discretion.

GROUP POLICY 

A group is designated as having a minimum of 10 guests in one booking. Payment for a group must be made as one sum and not on an individual basis. Final numbers for groups are required 48 hours prior to travel. If the group, due to cancellation, falls below the minimum number of 10 paying passengers, the group is no longer eligible for any applicable group rate. The booking will revert to a non-group booking at normal applicable FIT rates unless otherwise advised. 

GENERAL ADMISSION FOC POLICY

The following will be provided with Free of Charge Entry: 

• Children under the age of 2 

• 2 Teachers for primary, secondary, and tertiary groups 

• 1 teacher per 4 early learning childhood groups 

• 1 tour guide or language guide per group of 10 people 

CONDITIONS OF ENTRY

Saltwater Eco Tours and it's representatives reserves the right to refuse entry to any guest or group who:

i) is reasonably suspected of being unduly intoxicated or suspected of being likely to become unduly intoxicated (alcohol or drugs)

ii) behaves in a manner that would constitute a Public Nuisance whilst in line of sight of the venue

iii) engages in loud, obnoxious, unruly or anti-social behaviour.

Permission to board Saltwater Eco Tours is ultimately at the discretion of the Captain and any patron may be denied entry at their instruction.

CONDITIONS OF CARRIAGE (PASSENGER) GUIDELINES

1. Operation of the vessel and any of its equipment is restricted to the Captain and Crew of Saltwater Eco Tours.

2. No child or children aged 16 or under will be allowed onboard unless they are accompanied and supervised by an adult (18 years or over). 

3. No alcohol is to be bought onboard (BYO). Our vessel has a fully licensed bar with a range of local craft beer, local spirits and cocktails

4. The Captain and crew of Saltwater Eco Tours have total discretion as to the operation of the vessel including passenger loading, vessel route, carriage of goods, Responsible Service of Alcohol, acceptable conduct of passengers and the disembarkation of any offensive or intoxicated passengers.

5. All passengers are carried at their own risk. Saltwater Eco Tours does not accept responsibility or liability for any injury suffered whilst boarding, aboard or disembarking from any of its vessels.

6. Due to the unpredictable nature of the marine environment, on rare occasions cruises may end prematurely or extend beyond the scheduled end time. We will always endeavour to stick as close as possible to our proposed timings but the Captain ultimately determines boarding and alighting times to ensure safe passage of all patrons and guests.

7. Guests observed to engage in any of the following behaviours may have bar service restricted (1st instance) or be removed from the boat (subsequent instance):

i) Smoking or vaping

ii) Illicit substance use or more than one patron in bathrooms

iii) Unruly, loud or anti-social behaviour incl. chanting, swearing, singing over entertainment, mistreatment of vessel or equipment

iv) Rapid drinking or signs of undue intoxication; slurring, staggering/falling, unpredictable behaviour

If at any time the behaviour of patrons or the overall level of intoxication is assessed by Saltwater Eco Tours crew to be negatively impacting customer experience or increasing the risk of a marine incident the cruise may be terminated. Refunds will not be provided under these circumstances.

WAIVER OF CONSENT

Saltwater Eco Tours has CCTV throughout and also films and photographs some tours. You consent to being filmed or photographed by Saltwater Eco Tours (or its representatives) and to Saltwater Eco Tours using your name, likeness, image and/or voice in such photographs or films for the purpose of promoting our events, services, and products as well as for security and legal purposes. No remuneration is payable for any use thereof and permission will not be sought.

Saltwater Eco Tours respects the need for confidentiality of information and provides a secure framework to protect personal details held by the business from collection of information, use & disclosure, storage, security and accessibility.
